How cancellations, rescheduling and refunds are managed for OMS Media production bookings and engagements.
This policy explains how refunds, cancellations, replacements, credits and remedies are managed for OMS Media. Nothing in this policy limits rights that may apply under the Australian Consumer Law. Refunds and remedies depend on the type of product or service purchased, the reason for the request, whether the product or service has been accessed or delivered, and whether a major or minor problem exists.
No payments are taken through this website. There is no online shop, checkout or booking payment facility on this site. Video, podcast, photography, livestream and related production work is quoted individually and invoiced under a written engagement, so cancellations and refunds are managed against that engagement rather than an online order.
If you need to cancel or move a booked production day, tell us as early as possible. Where the notice period stated in your engagement is met, we will reschedule without penalty wherever crew, studios and equipment can be rebooked. Costs we have already committed on your behalf - such as crew bookings, studio or venue hire, equipment rental, talent fees, travel and permits - may be payable if they cannot be recovered. Short-notice cancellations may incur the production-day fee set out in the engagement.
Where a shoot cannot proceed because of weather, illness, venue closure or other circumstances beyond either party's reasonable control, we will work with you in good faith to reschedule without a cancellation fee wherever practicable. Committed third-party costs that cannot be recovered may still be payable.
If an engagement is cancelled after editing or post-production has begun, fees are payable for the work performed and the costs committed up to the date of cancellation. Completed stages can be delivered in their current state on request.
If OMS Media must cancel a booking and a suitable rescheduled date cannot be agreed, we will refund any amounts paid for work that has not been performed.
Where an engagement requires a deposit or prepayment, its treatment on cancellation is set out in the engagement. In general, deposits are applied first to costs already committed, and any balance for work not commenced is refunded.
Livestreamed events, hybrid events and other time-critical productions cannot usually be rescheduled, because the production is tied to the date of the event itself. If a livestream booking is cancelled, fees already incurred for planning, crew, equipment and platform setup are payable, and we will discuss whether recorded or alternative coverage can be arranged instead. Where the event proceeds but our services are no longer required, the cancellation terms in the engagement apply.
In some cases a credit toward future production work may be offered instead of a refund - for example where pre-production planning, scripts or storyboards can be reused for a rescheduled project. Credits are agreed in writing, do not expire earlier than stated in the engagement, and never replace any refund you are entitled to under the Australian Consumer Law.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If a service fails to meet a consumer guarantee, you may be entitled to have the problem fixed, to a resupply, or to a refund, depending on whether the failure is major or minor. This policy operates alongside those rights and does not replace them.
